Criminal History and DCJS

DCJS maintains fingerprint-based criminal history records for the state. They are not public. You cannot get another person's DCJS record. For your own, use the Record Review program. Get fingerprinted and pay about $77.75. Results take 7 to 10 business days.

Westchester County residents can find fingerprinting locations through DCJS or local agencies. This is the only path to an official New York State rap sheet. The Westchester County Department of Correction also maintains inmate records for people in county custody.

Criminal Record Sealing in Westchester County

Dismissed and acquitted cases seal on their own under CPL 160.50. No motion is needed. Court and police files are sealed. The person can deny the arrest happened.

Under CPL 160.59, a person may apply to seal up to two convictions after 10 years. Only one can be a felony. Sex offenses, Class A felonies, and violent felonies are not eligible. The $50 filing fee applies. The DA has a chance to weigh in. The judge decides. Youthful offender adjudications stay confidential under CPL 720.35.

The Clean Slate Act started November 16, 2024. Misdemeanor convictions seal 3 years after sentencing or release. Felony convictions seal after 8 years. Violent felonies, sex offenses, Class A felonies, and homicides are excluded. DCJS handles the process statewide, and that includes Westchester County records.

The WRO portal requires registration but lets you search 24/7. WebCrims and eCourts are free tools. For a Certificate of Disposition or other official court document, go through the County Clerk or the court that handled the case.

Criminal court records in Westchester County are presumptively public under Public Officers Law Article 6. Court records are covered by Judiciary Law 255. You do not need to be part of the case. You do not need a reason for your request.

Sealed cases under CPL 160.50 and CPL 160.59 are not available. Family Court records, juvenile matters, and youthful offender adjudications are confidential. FOIL requests go to the agency's Records Access Officer. The response time is 5 business days for acknowledgment. The Committee on Open Government can help with denied requests. Record retention follows state rules: felony cases are permanent, misdemeanors stay 25 years, violations 6 years. Appeals go to the Appellate Division, Second Department in Brooklyn.
