Criminal History and DCJS Records

DCJS maintains fingerprint-based criminal history records for the state. These are separate from court records and include arrest data, charges, and outcomes linked to fingerprints. They are not public.

To get your own DCJS record, use the Record Review program. You submit fingerprints at an approved location. The cost is about $77.75 and results take 7 to 10 business days. Otsego County residents may need to check the Oneonta area or nearby cities for fingerprinting sites. This is the only way to get an official rap sheet.

Sealing Laws for Criminal Records

Otsego County courts follow the same sealing rules as the rest of New York.

Cases that end in dismissal or acquittal seal on their own under CPL 160.50. No motion is required. All courts in Otsego County apply this rule.

Convictions can be sealed under CPL 160.59 after 10 years. A person can seal up to two convictions, only one being a felony. Sex offenses, Class A felonies, and violent felonies cannot be sealed. Youthful offender records stay confidential under CPL 720.35.

The Clean Slate Act became effective November 16, 2024. Misdemeanors automatically seal 3 years after sentencing or release. Felonies seal after 8 years. Sex offenses, Class A felonies, violent felonies, and homicides are excluded. DCJS handles the process statewide.
