Criminal History and DCJS Records

The Division of Criminal Justice Services keeps fingerprint-based criminal history records for the whole state. These are not the same as court records. DCJS files include arrest data, charges, and case outcomes linked to a set of prints. They are not public. You cannot get someone else's DCJS record through a FOIL request.

If you need your own rap sheet, use the Record Review program. You get fingerprinted at an approved site and pay about $77.75. Results take 7 to 10 business days. Columbia County residents can find print sites in the Hudson Valley and Capital District areas. This is the only way to get an official state criminal history in New York.

Criminal Record Sealing Laws

New York has several laws that allow criminal records to be sealed. These rules apply to Columbia County the same as everywhere else in the state.

When a case ends in dismissal or acquittal, records seal on their own under CPL 160.50. No motion is needed. The court and police seal their files. The person can say they were never arrested for that charge. This applies to every court in Columbia County.

For convictions, CPL 160.59 lets a person apply to seal up to two convictions after 10 years. Only one can be a felony. Sex offenses, Class A felonies, and violent felonies are not eligible. The court weighs the facts before deciding. Youthful offender records stay confidential under CPL 720.35 and do not appear in public searches.

The Clean Slate Act took effect on November 16, 2024. Misdemeanor convictions seal 3 years after sentencing or release. Felony convictions seal after 8 years. Sex offenses, Class A felonies, violent felonies, and homicides are left out. DCJS runs the sealing process for the whole state, and that includes Columbia County records.
